大陸海關扣押之物

大陸海關扣押之物保管期間需要由物之持有人給付費用（海關植物櫃，一天2元）這算不算侵犯人民的財產權益?台灣扣押應該沒有此規定吧

話說大陸海關2011年12月扣押了我的玩具槍，2012年入境時拘提我，指玩具槍拿去檢驗有問題，刑法追溯權怎麼可以一年後才立案，沒有經過合法傳喚就直接拘提拘禁我（大陸海關說我在台灣無法傳喚），要是在台灣這是非經法定程序逮捕拘禁得拒絕之吧？

我被大陸海關無理拘禁可否提出行政訴訟請求救濟？
