關於民法805條及置留權之行使

因為新聞的關係研究了一下民法805條，但發現資訊相當的混亂
很多人的說法都不一樣，而法務部也沒有明確解釋，所以想請問一下
拾獲人之報酬由原本的0.5~3成改為不得超過十分之一，且如有第八百零五條之一規定之情形，不得請求，這部分是確定的

但對於強制性的說法卻有很大的出入，有些人主張民法規定只要拾獲人提出要求，失主就必須支付，否則拾獲人可行使置留權
但有些人卻說即使是拾獲人提出要求，失主也不一定要給予，除非拾獲人可以舉證有因拾獲或交付遺失物時有時間或金錢上的支出才能要求失主給予合理補償，那實際上到底是如何??
