笨賊闖空門偷到睡著　竊盜未遂判3月

【張欽／台北報導】北市劉姓男子今年9月3日在北市中正區闖入周姓男子住處，在屋內翻箱倒櫃竊取2台照相機及5瓶洋酒，得手後竟因精神不濟，倒在周男的床上呼呼大睡，周男回家後驚見陌生男子睡在家中，立刻報警抓人。
 
劉男在台北地院審理時坦承犯行，法官認為，警方查獲時，劉男竊取物品並未脫離屋主支配範圍，認定劉男犯行屬侵入住宅竊盜未遂罪，審酌劉男缺乏尊重他人財物權觀念，危害社會治安，但坦承犯行，因此依侵入住宅竊盜未遂罪，判劉男3月徒刑，得易科罰金9萬元，全案可上訴。
