洪案效應 政院建議增訂軍審法第239條

針對陸軍下士洪仲丘所引發軍事檢察制度及審判制度是否可移轉到一般司法機關的議題，行政院政務委員羅瑩雪今日在行政院會提出報告，建議增訂「軍事審判法」第239條，該增訂條文如獲立院通過，未來類似洪仲丘的案子將可移到普通法院審判。

羅瑩雪表示，該增訂條文的重點還包括，其他已在偵查中尚未偵查終結的案件，可移到普通地檢署繼續偵查，在軍事法院審判中的案件，如尚未判決，也可移到普通法院繼續審理。

至於已經判決確定的案件，原則上不能抗告或上訴，但如符合刑事訴訟法申請再審或非常上訴的理由，還是可以向普通法院提出申請，因此有些各方認為需要重新解釋的案件，還是可能有機會翻案。
